Application for Transportation Service

Piedmont shall provide Service in accordance with the applicable Regulations and under the terms of the Tariffs. Service may only be provided after an Application for Service has been processed and accepted by Piedmont. Application forms are available from Piedmont upon request. Every item in the form must be properly completed, unless otherwise specified. Piedmont will notify those requesting Service of the information necessary to validate an invalid Application.

Service

After an Application for Service has been processed and the User accepted by Piedmont, the User may make use of the Site to request Service subject to the terms and conditions of the applicable Tariffs and Regulations. Any order or request for Service offered by Piedmont through this Site may be accepted by Piedmont without written authorization or signature from the User. Any such accepted order or request for Service shall be binding upon the User subject to the terms and conditions of the applicable Tariffs and Regulations.

Access 

In order to gain access to the Site maintained by Piedmont, a User must be issued a User ID and a confidential corporate password. The User is responsible for maintaining this information in a confidential fashion. Piedmont shall have no responsibility to the User for actions relating to the breach of this confidence should the User’s ID and/or corporate password be improperly used by others who are not authorized to access the Site with such IDs and passwords. The User agrees immediately to notify Piedmont if User becomes aware of any loss, theft or unauthorized use of User ID and corporate password. In order to gain access to the specific database containing commercial data, the User must be granted authority to enter the database. Such authority is issued by the Piedmont Gas Services Department and permits only specific User ID numbers access to this data. Every User given authority to access commercial data is instructed that information found on or entered at the Site may be confidential and that sharing User ID numbers and passwords with others is prohibited. After Service has been provided; information relating to the request for Service shall no longer be presumed confidential. However, Piedmont shall not release non-public information relating to that request to any third party except as required by regulatory or judicial authority.

Data Transmission

User acknowledges that data, including e-mail and electronic communications, may be accessed by unauthorized third parties when communicated between User and Piedmont, using the Internet, other network communications facilities, telephone or any other electronic means. User agrees to use software produced by third parties, including, but not limited to, "browser" software that supports a data security protocol compatible with the protocol used by Piedmont. Until notified otherwise by Piedmont, User agrees to use software that supports the Secure Socket Layer (SSL) protocol or other protocols accepted by Piedmont and follow Piedmont's log-on procedures for services that support such protocols. User acknowledges that Piedmont is not responsible for notifying User of any upgrades, fixes or enhancements to any such software or for any compromise of data transmitted across computer networks or telecommunications facilities, including, but not limited to, the Internet. With the exception of applications commonly known as web browser software, User agrees not to use any software, program, application or any other device to access or log on to Piedmont's computer systems, Site or proprietary software or to automate the process of obtaining, downloading, transferring or transmitting any content, information or quotes to or from Piedmont's computer systems, the Site or proprietary software.

Implied Agent Verification

Any User utilizing Piedmont Online to submit a nomination for an end user accepts all terms and conditions on the Agency Authorization Form submitted by the end user indicating the User as agent. Any such User can receive a copy upon request of the Agency Authorization Form as submitted by the end user.

Trademark Notice

Piedmont Natural Gas Company, Inc. and its various logos and slogans are trademarks and service marks of Piedmont.

Warranty Disclaimer

THIS SITE, INCLUDING ANY CONTENT OR INFORMATION CONTAINED WITHIN IT OR ANY SITE-RELATED SERVICE, IS PROVIDED "AS IS" WITH NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EITHER EXPRESSED OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NONINFRINGEMENT. Errors and Defects

Piedmont does not warrant that the functioning of this Site or the Internet shall be uninterrupted or error-free or that defects will be corrected.

Miscellaneous

Issues relating to this Application for Website Access shall be governed by and construed in accordance with the laws of that state, exclusive of its choice of law rules. The User submits to the exclusive jurisdiction of the state and federal courts sitting in the County of Mecklenburg in the state of North Carolina, and waives any jurisdictional, venue, or inconvenient forum objections to such courts. In any action relating to the Application or Site, the prevailing party will be entitled to reasonable attorneys’ fees and costs.

Modification and Termination

Piedmont may modify the terms of this Application by posting notice of such modification herein before the modification takes effect. Piedmont reserves the right to modify or discontinue this Site at any time. This Agreement may be modified by Piedmont upon written notice to you provided, however, that if Piedmont sends User written notice, via electronic communication or otherwise, of a modification, User confirms User's acceptance of the modification by not closing and/or by continuing to use User's account.
